FORUM JASA KONSTRUKSI
Selasa, 26 September 2023
FORJASIB ; In the context of government investment in mining companies, Article 33 of the 1945 Constitution has a sharp and significant application. Article 33, paragraph (3) states that the earth, water, and natural resources contained therein are controlled by the state and used for the greatest prosperity of the people. Therefore, government investment in mining companies must adhere to this fundamental principle, ensuring that the economic benefits produced are in line with the prosperity of all Indonesian people.Articles 33, paragraph (2) and (3) emphasize the importance of state control over vital production branches for the country and the interests of the public. In the context of mining companies, this demands management that prioritizes national interests and maintains a balance between economic growth, environmental protection, and social benefits.Article 43 emphasizes that the use of foreign labor must comply with requirements that are appropriate to the needs. Therefore, government investment in mining companies must pay attention to these provisions, so that local labor is not disadvantaged and the use of foreign labor is done wisely.Articles 44 and 45, paragraph (1) establish a legal framework that regulates the implementation of Article 33 of the 1945 Constitution through government regulations and appropriate corporate forms. Therefore, in making government investments in mining companies, it is important to ensure that regulations and corporate structures comply with the principles set forth in the 1945 Constitution. Thus, when the Banyuwangi Regency government considers investing in the mining company PT. Merdeka Copper Gold, it is necessary to understand that a commitment to the principles of Article 33 of the 1945 Constitution is key to achieving results that are in line with national interests and the welfare of the people. Mistakes in investment policies can have serious consequences, including potential legal and social controversies involving the government. Therefore, careful consideration and deep understanding of constitutional principles are a must. (ADV.BUDI KURNIAWAN S.SH/WAKETUM ASKONAS PROPINSI JAWA TIMUR)
